Chapter 330 Permits
Dear Howell Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
1 documents, including applications, from August 2025 through the present day referring, reflecting or relating to permits issued for special events under Chapter 330 of the Howell code, including all supporting documentation required to be created by Township Departments under that ordinance. The term "special event" shall have the meaning set forth in Chapter 330 and include all events set forth therein.
2 all application materials and approval including sketches and reviewer comments for public event permit associated with Howell South Little League opening day parade on April 12 2026.
3 police department comments and all approval documents associated with any public event permit.
4 correspondence including texts and emails between governing body members, township attorney and township manager regarding special events as that term is defined in Chapter 330 in the last 6 months including keywords “parade”, “procession”, “little league” "orthodox" "torah"

4 correspondence including texts and emails between governing body members, township attorney and township manager regarding special events as that term is defined in Chapter 330 in the last 6 months including keywords “parade”, “procession”, “little league” "orthodox" "torah"

The remaining document requested will not be provided as the request requires research rather than identifying specific records. OPRA obligates the custodian to produce identifiable government records; it does not require the custodian to search the agency’s files, analyze their contents, and exercise judgment to determine which records "concern" a given subject. See MAG Entertainment, LLC v. Div. of ABC, 375 N.J. Super. 534 (App. Div. 2005); Bent v. Stafford Police Dep't, 381 N.J. Super. 30 (App. Div. 2005). Moreover, you request for emails does not meet OPRA's specificity requirements for electronic correspondence. OPRA requires that a request for emails identify the specific individuals who sent or received the correspondence, the subject matter, and a time period. Your request does not meet those requirements.
