This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
EnviroSure is conducting a Phase I ESA at 353 Crider Avenue (Block 701; Lot 33). In that regard, we are requesting a search of all files pertaining to the property. Especially, underground storage tanks, environmental concerns, building permits and ownership records.

Please be advised that your request has been received.
A search for identifiable records, i.e., underground storage tanks, environmental concerns, building permits and ownership records, will be performed and a response, within seven business days, will be provided. However, please be advised that the portion of your request for a "search of all files pertaining to the property" is broad and unclear and is therefore, denied (in that specific regard).
Under OPRA, public agencies are required to disclose only identifiable records. See MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J.Super. 534, 546 (App. Div. 2005). The Court further held that "[u]nder OPRA, agencies are required to disclose only ‘identifiable’ government records not otherwise exempt ... In short, OPRA does not countenance open-ended searches of an agency's files." (Emphasis added.) Id. at 549.
