Subpoenas Received

Response to this request is long overdue. By law, under all circumstances, New Brunswick Housing Authority should have responded by now (details). You can complain by requesting an internal review.

Dear Mr. Toto,

Unfortunately, your predecessor Mr. Clarke left several of my pending OPRA requests unfulfilled, and the authority has been recklessly risking legal liability by not complying with the state statute NJSA 47:1A.

The NBHA never responded to my August 3 request for subpoenas received by the agency. Please provide the requested records.

I understanding that you have several pending Open Public Records Act
requests. At this time, I can provide you with the following records:

 

 

1.     The contract between the Housing Authority and Manfredi & Pellechio
(now unredacted).

 

2.     The report showing all amounts paid to Manfredi & Pellechio for the
period of May 1, 2019 through September 26, 2023 (our system does not go
back any farther).

 

3.     The 2023-24 DCA budget introduced by Resolution 2023-05/24 #19.

 

4.     The adopted 2023-24 DCA budget.

 

5.     Resolution 2023-08/28 #29 and the memorandum detailing the basis
for the change order.

 

Due to the ongoing transition process, the NBHA has not yet been able to
complete the search for the following records and hereby requests an
extension of fourteen (14) days:

 

1.       Payroll records showing the total compensation paid to John
Clarke for each year of his employment. 

 

2.       All civil subpoenas received since July 1, 2022. As you know, if
any criminal subpoenas were received by the Housing Authority since July
1, 2022, they would be exempt from disclosure. See N.J.S.A. 47:1A-3(a).
