Subpoenas Received

Response to this request is long overdue. By law, under all circumstances, Franklin Township Housing Authority (Somerset) should have responded by now (details). You can complain by requesting an internal review.

Dear Franklin Township Housing Authority,

I am a reporter covering public housing as well as other government and public interest news. Under the OPRA and the common law right of access, please provide copies of all subpoenas received by the authority since July 1, 2022, including subpoenas duces tecum and subpoenas ad testificandum. Not sure subpoenas are public record and especially grand jury subpoenas. I’m going to research the request and get back to you.

With regard to civil matters, there are no records responsive to your
request.

 

With regard to criminal matters, if any such subpoenas were received by
the Housing Authority since July 1, 2022, they would be exempt from
disclosure. See N.J.S.A. 47:1A-3(a).

Thanks for your response. I'm very familiar with N.J.S.A. 47:1A-3(a), and I don't know what part of it you believe prohibits or exempts criminal grand jury subpoenas from disclosure. Please advise what language you are referencing in this denial of access.
