Subpoenas Received
Dear Princeton Housing Authority,
I am a reporter covering public housing as well as other government and public interest news. Under the OPRA and the common law right of access, please provide copies of all subpoenas received by the authority since July 1, 2022, including subpoenas duces tecum and subpoenas ad testificandum. I am in receipt of your OPRA request. The document you seek are exempt from disclosure pursuant to N.J.S.A. 47:1A-3(a) that provides:
a. Notwithstanding the provisions of P.L.1963, c.73 (C.47:1A-1 et seq.) as amended and supplemented, where it shall appear that the record or records which are sought to be inspected, copied, or examined shall pertain to an investigation in progress by any public agency, the right of access provided for in P.L.1963, c.73 (C.47:1A-1 et seq.) as amended and supplemented may be denied if the inspection, copying or examination of such record or records shall be inimical to the public interest; provided, however, that this provision shall not be construed to allow any public agency to prohibit access to a record of that agency that was open for public inspection, examination, or copying before the investigation commenced. Whenever a public agency, during the course of an investigation, obtains from another public agency a government record that was open for public inspection, examination or copying before the investigation commenced, the investigating agency shall provide the other agency with sufficient access to the record to allow the other agency to comply with requests made pursuant to P.L.1963, c.73 (C.47:1A-1 et seq.)

Thanks for your response. I am somewhat confused by it. Are you saying that it would be inimical to the public interest to release the subpoenas received by the Princeton Housing Authority? If so, can you please explain what facts or laws you are basing this conclusion on?
Can you please also clarify how many subpoenas has the PHA received since 7/1/22? Your message refers to a singular "document" but uses the word "are" which would imply plural. Thanks very much.

I thought that common courtesy and perhaps a commitment to government transparency might "compel" you to respond substantively to rather than stonewall or dodge the questions. As a reporter, I was asking them to give you a chance to explain your decision. If you do not wish to engage unless and until you are legally required to do so, then I will simply take up these issues with higher authorities.
