Dear Atlantic City Housing Authority,
I am a reporter covering public housing as well as other government and public interest news. Under the OPRA and the common law right of access, please provide copies of all subpoenas received by the authority since July 1, 2022, including subpoenas duces tecum and subpoenas ad testificandum. Mr. Kratovil: Our firm serves as General Counsel to the Atlantic City
Housing Authority. Ms. Shample forwarded your August 8 OPRA request for
copies of all subpoenas received by the ACHA since July 1, 2022. Could you
provide me with one clarification of the scope of your request?
Subpoenas related to any criminal investigation would of course be exempt
from disclosure as criminal investigatory records. Subpoenas in the
various civil matters in which the ACHA is involved would be covered by
OPRA. Were you interested in receiving copies of those subpoenas?

Following up on our conversation today, I hereby withdraw my request for any civil subpoenas. With respect to any criminal subpoenas I will consider prior your response as a denial of access to the records with the stated reason for the denial being the criminal investigatory records exemption to the OPRA.
