The Township of North Bergen (the “Township”) received your request dated
08/16/2025 under the New Jersey Open Public Records Act (“OPRA”), N.J.S.A.
47:1A-1 et seq. The Township requires an extension until September 3,
2025, to continue gathering responsive records.
As with any OPRA request, you have the right to challenge the decision by
the Township. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
records Council (“GRC”) by completing the Denial of Access Complaint Form.
You may contact the GRC by toll-free telephone at 866-850-0511, by mail at
PO Box 819, Trenton, NJ 08625, by e-mail at [email address], or at its
web site at [1]www.state.nj.us/grc. The Council can also answer other
questions about the law. All questions regarding complaints filed in

Township Response:
See attached records for 4201 Bergen Turnpike, 1414 85th Street, 1207 67th Street, 7022 Cottage Avenue, 6719 Meadowview Avenue, 6233 Kennedy Blvd. The Township has no records responsive for the remaining 10 properties.
You also requested:

Township Response:
Your request is improper. First, it is overbroad in that it fails to contain any temporal limitation, Second, your request would require the Township to conduct research, which is beyond the scope of the Open Public Records Act. OPRA only requires the disclosure of identifiable government records. The Township is not obligated to read through potentially responsive records and sort out those which are relevant. Therefore, your request is denied pursuant to MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005). Notwithstanding this objection, see records responsive to Request #3, for agendas and minutes which may be responsive to this request. See also attached applications, Resolutions and transcripts for the relevant properties for the Board of Adjustment.

Qualifications for planning and zoning board members are set forth in N.J.S.A. 40:55D-23 and N.J.S.A. 40:55D-23, respectively, which are part of the New Jersey Municipal Land Use Law.
