A digital copy of the most recently approved memorandum of ALL collective bargaining units with which the township, city, borough, etc., currently holds active agreements.

Please include the most recent contract booklet (signed or unsigned), the most recent memorandum of agreement, salary guides, and any sidebar agreements, if applicable.

Dear Curious Taxpayer,
This request seeks information or asks questions and does not identify specific government records. As such, your request is an invalid OPRA request and is denied. When a request is “complex” because it fails to specifically identify the documents sought, then that request is not “encompassed” by OPRA. See New Jersey Builders Association v. New Jersey Council on Affordable Housing, 390 N.J.Super. 166, 180 (App. Div. 2007). A proper request under OPRA must identify with reasonable clarity those documents that are desired, and a party cannot satisfy this requirement by simply requesting "ALL" of an agency's documents. See Bent v. Stafford Police Department, 381 N.J.Super. 30, 37 (App. Div. 2005). Custodians are not required to conduct research or create new records in response to an OPRA request. Please provide me with the specific collective bargaining documents you are requesting and a time frame for those documents. Attached is the official LEHT OPRA form. Please fill out the form and resubmit it back to me directly at this email address. Once the specific information and time frame is provided I will then forward to the appropriate departments.

Where am I asking a question? When is collective bargaining agreements not government records?

A proper request under OPRA must identify with reasonable clarity those documents that are desired, and a party cannot satisfy this requirement by simply requesting "ALL" of an agency's documents.

I will rephrase my request as "Active collective bargaining unit agreements with Little Egg Harbor Township."

"Custodians are not required to conduct research or create new records in response to an OPRA request."

As an OPRA Custodian, you are not "creating" these agreements, they already exist.

"Please provide me with the specific collective bargaining documents you are requesting and a time frame for those documents."

Like I said in my original request "active" collective bargaining agreements, meaning current ones that are not expired.

"Attached is the official LEHT OPRA form. Please fill out the form and resubmit it back to me directly at this email address."

I am not required by-law to fill out any official forms.
