Floor Plans: You have requested access to building plans in your OPRA
request attached. N.J.A.C. 5:3-2.2 (a) 1. provides that building plans
submitted in conjunction with any permit application are exempt from
disclosure under OPRA. The Reason for this exemption is building plans
contain details about building construction and also about building
security and safety systems that should not be available to just anyone on
request.
Under the common law right of access to public records, the building plans
may still be available. The common law right of access to public records
does not prohibit an individual from receiving the record as long as they
demonstrate a valid reason for doing so. The individual requesting the
record must submit a written request to the Construction Official, Daniel
Newman, stating the reason for obtaining or viewing the record. If the
explanation is reasonable, access to the public record is granted.
N.J.S.A. 47:1A-1 (Legislative Findings)
1) Privacy Interest - “a public agency has a responsibility and an
obligation to safeguard from public access a citizen's personal
information with which it has been entrusted when disclosure thereof would
violate the citizen's reasonable expectation of privacy.” See Burnett v.
Cnty. of Bergen, 198 N.J. 408 (2009).

Though the Office of the Township Clerk processes all of the OPRA requests
for the Township, we cannot answer questions regarding documents obtained
from other departments.

Dear Jillian VonGlahn,
The property record cards, among other records, were not included in what was sent. I noticed the link you sent me is labeled "OPRA # 489-23 (1)." Is it possible that there is an additional link, possibly "OPRA # 489-23 (2) " that might include the property record cards, etc...
If so, please send that link.
