Dear Cranford Township Clerk:

I am writing in response to your denial of my OPRA request seeking emails between Cranford Council members. Specifically, you appear to claim that email headers (showing To/From/Cc/Bcc fields identifying the senders and recipients, along with date/time) are exempt because they do not include the body or full subject line of the emails. You have also requested an extension of time, which I hereby deny. My original request for the emails includes all attachments, as they form an integral part of the email records.

Your denial is inconsistent with the Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., and controlling case law. I demand immediate production of the responsive records, including the header information and attachments, with any necessary and narrowly tailored redactions only for information that actually falls within a specific statutory exemption.

1. OPRA's Broad Definition of Government Records Applies to Emails and Header Information OPRA creates a strong presumption of access: "government records shall be readily accessible for inspection, copying, or examination by the citizens of this State, with certain exceptions, for the protection of the public interest." N.J.S.A. 47:1A-1. A "government record" includes "any paper, written or printed book, document ... information stored or maintained electronically ... that has been made, maintained or kept on file in the course of his or its official business." Emails sent or received by public officials (such as Council members) concerning official municipal business are government records, regardless of whether they are on township servers or personal accounts. The content, transactional information (including headers), and attachments are all part of the record.1f910d
2. Email Headers (Sender, Recipient, Date, etc.) Are Not Exempt – Paff v. Galloway Controls

The New Jersey Supreme Court directly addressed this issue in Paff v. Galloway Township, 229 N.J. 340 (2017). In Paff, the requester sought an email log showing sender, recipient, date, and subject for emails between the Township Clerk and Police Chief. The Township argued it did not have to produce the information because no pre-existing "log" existed and extraction would create a new record.

The Supreme Court unanimously rejected that position. It held that electronically stored information extracted from emails — specifically including the fields for sender, recipient, date, and subject — constitutes a "government record" under OPRA. Producing such data is not "creating a new record"; it is simply providing accessible electronically stored information. The Court emphasized that OPRA applies to information in electronic form, even if extracted from a larger document.

Your position — that basic routing headers (To/From fields showing only to whom the emails were sent, without body or full subject) are exempt simply because they lack substantive content — is the opposite of Paff's holding. Headers limited to identifying the parties involved in official communications are even less likely to implicate exemptions than a full subject line or body. No blanket exemption exists for such limited header data involving municipal Council members conducting public business.

Subsequent GRC decisions have followed Paff and required disclosure of email logs or header information. For example, in complaints citing Paff, custodians were ordered to produce email logs containing basic sender/recipient/date information.

Recent Appellate Division authority reinforces this: In Rosetti v. Ramapo-Indian Hills Regional High School Board of Education (App. Div. 2025), the court held that email logs on public officials' personal computers/private servers are government records under OPRA when they concern official business. The logs should include sender, recipient, Cc/Bcc, date/time, subject, and identification of attachments.

2024 OPRA Amendments (P.L. 2024, c.16, effective September 3, 2024) do not create a blanket exemption for basic email headers between Council members. The amendments exempt "metadata" defined as "structured reference data ... which shall include the SMTP header properties of emails, except that portion that identifies authorship, identity of editor, and time of change." N.J.S.A. 47:1A-1.1 (as amended). Basic To/From/Cc fields for official communications are not the type of technical SMTP properties carved out; they are transactional information identifying the public officials involved in township business.

Exemptions under OPRA (N.J.S.A. 47:1A-1.1) must be construed narrowly and applied on a case-by-case basis with particularity. None of the listed exemptions (e.g., advisory/consultative/deliberative material, attorney-client privilege, specific PII protections for personal email addresses/phone numbers required for government services, etc.) automatically apply to bare routing headers showing only who sent/received official emails. If any portion of a record contains exempt material, the non-exempt portions (including headers) must still be disclosed with targeted redactions. N.J.S.A. 47:1A-5(g); see also Paff (requiring evaluation for redactions where needed).

3. Attachments Are Part of the Email Records
My request for the "emails" necessarily includes all attachments, as they are integral components of the email communication. State records management principles and OPRA treat the full message — content, transactional data, and associated attachments — as the government record. Withholding attachments would render any production incomplete and violative of OPRA.

4. Extension Request is Denied
OPRA generally requires a response (grant, denial, or valid extension) within seven business days. While custodians may request reasonable extensions for good cause, requesters are not required to agree. Your extension request is denied. Continued delay beyond the statutory timeframe will be treated as a constructive denial of access under N.J.S.A. 47:1A-5(i). Failure to produce the records promptly may subject the custodian to penalties and attorney fees upon a successful challenge.

Demand for Production and Next Steps
I demand that you produce the responsive email records, including headers (To/From/Cc fields, date/time) and all attachments, within five (5) business days of this letter. Any redactions must be accompanied by a detailed explanation citing the specific statutory exemption and the information redacted.

If you fail to comply, I will file a Denial of Access Complaint with the Government Records Council (GRC) and/or Superior Court, seeking production of the records, a finding of unlawful denial, costs, and attorney fees. I will rely on Paff v. Galloway Township, 229 N.J. 340 (2017); Rosetti v. Ramapo-Indian Hills (App. Div. 2025); N.J.S.A. 47:1A-1, 47:1A-1.1 (as amended), and related GRC decisions.

Please confirm receipt and provide a production timeline immediately.
