Hello Ms. Gilmore,
As I indicated, I do not wish to pay a special service charge, which is
why I dramatically narrowed the scope of my original request. There is
simply not an "extraordinary expenditure of time and effort" required to
produce the 24 pages of bills requested, and I suspect that they do not
require "significant redaction" because only the portions which are truly
privileged or confidential can be redacted legally. I highly doubt there
is privileged/confidential information on every single one of the 24 pages
requested, but even if that is the case, 1.2 hours is simply not an
"extraordinary" amount of time.
I respectfully decline to pay the special service charge. Please produce
the records immediately or I will be forced to file litigation challenging
this as a violation of the Open Public Records Act.

Dear Mr. Kratovil:
Please accept the following as the Harrison Housing Authority
(“HHA”)’s formal response to your March 14, 2018 Open Public Records
Act (“OPRA”) request for “copies of all bills, vouchers, or receipts for
work performed by any attorneys or law firms working for the Harrison
Housing Authority since Jan. 1, 2018.”
The Open Public Records Act specifically states that attorney bills or
invoices “may be redacted to remove any information protected by the
attorney-client privilege.” N.J.S.A. 47:1A-
1.1. Moreover, pursuant to N.J.S.A. 47:1A-5(c), the HHA is
permitted to impose a special service charge where an extraordinary
expenditure of time and effort would be required to accommodate an OPRA
request. Here, you have requested approximately two (2) months of legal
bills, which require significant redaction in order to protect personnel
matters in accordance with N.J.S.A. 47:1A-10, the attorney-client
privilege of the Board of Commissioners (“Board”), and all other
confidential matters identified by N.J.S.A. 47:1A-1.1. The HHA would
have to expend an extraordinary amount of time and effort to perform the
necessary redactions, as every single page of the requested records will
need to be reviewed, manually redacted with a dark colored marker, and
copied to ensure that the redacted text will not be visible. Therefore,
the HHA will impose a special service charge on your OPRA request.
Due to the fact that the bill contains attorney client privilege matters
between the Board and its attorney, together with personnel and other
confidential matters identified within N.J.S.A. 47:1A-1.1, the
lowest-level HHA employee capable of accessing the requested records and
performing the necessary redactions is the Administrative
Services Manager, who currently makes
$48.36 per hour. This is so because lower level employees cannot be
privy to matters within the Board’s attorney client privilege or
personnel matters involving their coworkers. It is estimated that the
requested records contain twenty four (24) pages and proper redaction
will take three (3) minutes per page. Therefore, the redaction of all
requested records will take an estimated one and two tenths (1.2)
hours. As a result, the HHA hereby imposes a special service
charge of Fifty Eight and 03/100 Dollars ($58.03). Work cannot begin
on accommodating your request unless and until you pay such charge to
the HHA.
