Dear Haledon Borough,

By letter dated March 25, 2019, Lt. George Guzman responded to my OPRA request for "Public Synopsis of Disciplinary Actions for years 2014 to 2018" as follows:
"Please be advised that, pursuant to Requirement 10 of the New Jersey Attorney
General’s Internal Affairs Policy and Procedures (Page 44), a Public Synopsis of
Disciplinary Actions is generated when an officer is fined or suspended for ten (10)
or more days. This office does not have any record of an officer being fined or
suspended for ten (10) or more days between 2014 and 2018. As such, a Public
Synopsis of Disciplinary Actions does not exist. "

Requirement 10, on Page 44, provides: "Each agency must release reports to the public summarizing the allegations received and the investigations concluded for that period. In addition, the agency shall periodically release a brief synopsis of all complaints where a fine or suspension of 10 days or more was
assessed to an agency member." Please note the language "In addition, . . ."

My request, therefore, encompasses the reports that Requirement 10 mandate be kept and released to the public (that is, those reports "summarizing the allegations received and investigations concluded during the relevant period."). To the extent the Haledon Police Department maintains those reports in a document separate from the Public Synopsis, those reports are respectfully requested. To the extent Haledon Police Department is not compliant with the Attorney General's Internal Affairs Policy, please disclose the same.
