Employee Salaries, Overtime, and Suspensions as of 7/1/18
Dear Middlesex County,
This is a request for public records made under OPRA and the common law right of access. Please acknowledge receipt of this message.
Records requested:
1) name, title/position, department/division, salary, and hire date for all current employees as of today (July 1, 2018)
2) total overtime pay year-to-date for all current employees (or if your agency operates on a July-June fiscal year budget cycle, their total overtime pay for the 2017-2018 fiscal year)
3) the names of all employees currently suspended with pay
4) the names of all employees currently suspended without pay

Attached please find a spreadsheetwhich is responsive to items 1 and 2 of
your request.
With regard to items 3 and 4,names of employees suspended with and without
pay, please be advised that theCounty is prohibited from disclosing
personnel records pursuant to N.J.S.A.47:1A-1.1 et seq. OPRA mandates
that, “the personnel or pension recordsof any individual in the possession
of a public agency, including but notlimited to records relating to any
grievance filed by or against an individual,shall not be considered a
government record and shall not be made available forpublic access[.]”
N.J.S.A. 47:1A-10. Further, in Vaughnv. City of Trenton (Mercer), GRC
Complaint No. 2009-177 (June 2010), theGovernment Records Council held
that, “[a]lthough the Custodian violated OPRAat N.J.S.A. 47:1A-5.g by
failing to provide a response to theComplainant’s request for the
disciplinary history for Trenton PoliceDepartment Detective, Robert
Sheehan (retired), said record is exempt fromdisclosure as a personnel
record pursuant to N.J.S.A. 47:1A-10 and Merinov. Borough of Ho-Ho-Kus,
GRC Complaint No. 2003-110.
Disciplinary records of Countyemployees are personnel records within the
meaning of N.J.S.A. 47:1A-10,and are thus exempt from disclosure.
Accordingly, items 3 and 4 of your requestare denied.
