Mr. Packer,
This correspondence shall serve as Nutley Township (the “Township”)’s
response to your request for access to government records pursuant to the
Open Public Records Act, N.J.S.A. 47:1A-1.1, et seq. (“OPRA”), which was
received via e-mail dated February 19, 2019. Below is a list of each
request for access and the Township’s response to the same.
1. “The listed duties and responsibilities of Detectives, Supervisors,
Police Officers assigned to the Anti-Crime Unit of the Nutley Police
Department and their main mission.” Attached is the NJ Civil Service
Commission job specifications for Detectives Supervisors and Police
officers.
2. “Productivity Numbers of the Patrol Division -not name specific
just totals of arrests , citations, field interviews, etc.” Please
resubmit with a timeframe. See below

If a request does not name specifically identifiable records or is overly
broad, a custodian may deny access pursuant to the following court
decisions: MAG Entertainment, LLC v. Division of Alcoholic Beverage
Control, 375 N.J.Super. 534 (App. Div. 2005), Bent v. Stafford Police
Department, 381 N.J. Super. 30 (App. Div. 2005), New Jersey Builders
Association v. New Jersey Council on Affordable Housing, 390 N.J. Super.
166 (App. Div. 2007), and Schuler v. Borough of Bloomsbury, GRC Complaint
No. 2007-151 (February 2009). Requestors shall identify types of records,
dates, parties to correspondence, subject matter, etc. A custodian is
obligated to search their files to find the identifiable government
records listed in the complainant’s OPRA request. A custodian is not
required to research their files to figure out which records, if any,
might be responsive to a broad and unclear OPRA request.
If your request for access to a government record has been denied or
unfilled, you have a right to challenge the decision by the Township of
Nutley to deny access. At your option, you may either institute a
proceeding in the Superior Court of New Jersey or file a complaint with
the Government Records Council (GRC) by completing the Denial of Access
Complaint Form. You may contact the GRC by toll-free telephone at
866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by e-mail at

GRC can also answer other questions about the law. All questions
regarding complaints filed in Superior Court should be directed to the
Court Clerk in your County.
