Complete Railcar Traffic Volume Records for 65 Central Ave, Kearny, NJ
Dear New Jersey Department of Environmental Protection,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
Records requested:
Pursuant to the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., I submit this follow-up request concerning my prior OPRA request for railcar traffic volume flowing through the road–rail waste transfer station located at 65 Central Avenue, Kearny, New Jersey.
In response to my prior request, NJDEP produced records reflecting only first-quarter (Q1) volume data for a limited period (2023-2025). This follow-up request seeks the complete and corresponding records that capture the full scope of railcar traffic volumes for all reporting periods and all reporting entities.
Specifically, I request access to and copies of the following records, whether maintained in paper or electronic form:
1. Complete Railcar Traffic Volume Records (All Reporting Entities)
All records reflecting railcar traffic volumes associated with the road–rail waste transfer station at 65 Central Avenue, Kearny, New Jersey, as reported by Interstate Waste Services (IWS) and/or New Jersey Rail Carrier LLC, for:
○ All four calendar quarters (Q1, Q2, Q3, and Q4) for each year,
○ For rail-related volume reporting for this facility from January 1, 2003, through the present.
This request includes, but is not limited to, quarterly reports, annual summaries, operator submissions, internal tracking spreadsheets, databases, emails, attachments, and any compilations, roll-ups, or summaries of such data maintained by NJDEP, regardless of whether the data originated with IWS, New Jersey Rail Carrier LLC, or another reporting party.
2. Measurement Units and Methodology
All records that define, describe, or explain how railcar traffic volumes reported by IWS and/or New Jersey Rail Carrier LLC are measured, calculated, and recorded, including:
○ The unit(s) of measurement used (e.g., railcars, standardized railcar equivalents, tonnage, weight, volume, or other units),
○ Any assumptions regarding railcar size or capacity,
○ Any conversion factors applied (for example, railcars to tons),
○ Any changes in definitions, assumptions, or reporting methodology over time.
3. Reporting Standards and Guidance
Any guidance documents, instructions, reporting forms, or correspondence provided by NJDEP to IWS and/or New Jersey Rail Carrier LLC specifying how railcar traffic volumes must be measured, calculated, or reported.
4. Data Completeness, Gaps, or Limitations
If NJDEP does not possess complete quarterly or annual records for any portion of the requested timeframe, please provide records or written documentation explaining:
○ Which entity (IWS, New Jersey Rail Carrier LLC, or another party) was responsible for reporting during the relevant period,
○ Why the records are incomplete or unavailable,
○ Whether the records were never collected, were collected but not retained, or were otherwise lost or destroyed,
○ The applicable records retention policy governing such data.
If any portion of this request is denied or records are withheld, please identify the specific statutory basis for denial and describe the records withheld with sufficient detail to permit review. If clarification is required to process this request, I ask that NJDEP contact me before denying any portion as insufficiently specific.
Records in electronic format (PDF, Excel, CSV, or native electronic form) are preferred.
