Dear Garwood Borough,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL use the requested government records for a commercial purpose (Real Estate).
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Code Violation List Request for 06/11/2026 to 07/30/2026 . I kindly request a list of all UNRESOLVED or OPEN code violations (please do not include closed violations) for all properties in the city during this time period, specifically related to property maintenance, structural issues, and weeds. Please include descriptions of the violations, property addresses, and violation dates. I also prefer for the document to be sent here in OPRA not in my email (sometimes it does not appear in my inbox). Thank you so much!

I am writing in response to your request pursuant to the Open Public
Records Act (“OPRA”). You requested the following:
Code Violation List Request for 06/11/2026 to 07/30/2026 . I kindly
request a list of all UNRESOLVED or OPEN code violations (please do not
include closed violations) for all properties in the city during this time
period, specifically related to property maintenance, structural issues,
and weeds. Please include descriptions of the violations, property
addresses, and violation dates.
Please be advised that, P.L. 2024, c. 16, which became effective September
3, 2024, provided changes to OPRA legislation. One of the changes being if
an OPRA request is for "Commercial Purposes" (N.J.S.A. 47:1A-5,(g)), then
the response time is extended from seven (7) business days to fourteen
(14) business days, given that the custodian of record notifies the
requestor of the additional time within seven (7) business days. N.J.S.A.
47:1A-5(i).
Given that the Borough is required to compile, review and redact the
records you have requested for Commercial Purposes, the Borough
anticipates finalizing your request by August 19, 2026. The Borough also
reserves the right to request an additional extension of time if
necessary. See Scheeler v. New Jersey Department of Educ., GRC Complaint
No. 2014-123 (2016).
