Dear New Jersey Board of Public Utilities,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Records requested:

City of Salem, NJ has determined that one or more Emergent Conditions exists and that it is necessary to invoke WIPA, and as such has retained the services of an independent financial advisor to review, analyze, and report on the value of the system, the short- and long-term impact to rate-payers of the cash-flow structure of the proposed transaction, and provide an estimate of any financial requirements necessary to address the Emergent Conditions and to operate and maintain the system.

1. Please advise whether or not the CITY OF SALEM transmitted copies of the independent financial advisor’s analysis and review to the Board of Public Utilities (BPU) within the required 10 days timeframe of the City’s approval of the report (per N.J.S.A. 58:30-5.c.)

2) If report was submitted to BPU, please provide copy of submission

Dear Ms. Tupelo:

In response to your request, we are providing the attached documents from the City of Salem in relation to the Water Infrastructure Protection Act.

Notwithstanding the foregoing, please note that your request is overbroad in that, aside from asking for records, it asks various questions, which seek information, not specific records. OPRA does not allow a wholesale request for general information. Gannett N.J. Partners, LP v. Cty. of Middlesex, 379 N.J. Super. 205, 212 (App. Div. 2005); MAG Entm’t, LLC v. Div. of Alcoholic Beverage ControZWl, 375 N.J. Super. 534, 549 (App. Div. 2005); Bent v. Twp. of Stafford Police Dep’t, 381 N.J. Super. 30, 36-37 (App. Div. 2005); Spectraserv, Inc. v. Middlesex Cty. Utils. Auth., 416 N.J. Super. 565, 578 (App. Div. 2010); N.J. Builders Ass’n v. N.J. Council on Affordable Hous., 390 N.J. Super. 166, 178-79 (App. Div. 2007). Accordingly, we are responding to your request for documents and no response to the questions is provided.

This matter is now closed. This response does not waive or limit any other rights afforded to it under OPRA, N.J.S.A. 47:1A-1 et seq., or the common law, which are expressly reserved.

Sincerely,
Carmen D. Diaz
