Dear Rowan Faculty 4 Transparency/Stockton Faculty 4 Transparency:
 
I acknowledge receipt of your request for an internal review of the
response to OPRA Request 081121-1.  Having reviewed your request for
reconsideration, the University’s response is unchanged.
 
Your initial request sought information - i.e., the “[p]ercentage of
Stockton employees that are vaccinated” and the “[p]ercentage of Stockton
students that are vaccinated. As stated, the request does not seek an
identifiable government record as that term is defined in N.J.S.A.
47:1A-1.1., and is therefore not a valid OPRA request. In addition to
being invalid, your information request also was vague, overly broad, and
lacked parameters (e.g., type of immunization, date range, etc.) See
Government Records Council Citizen's Guide to OPRA (May 2020), page 16,
for guidance on the submission of a valid request, located at

definition of a “government record” does not include inter-agency or
intra-agency advisory, consultative, or deliberative material.
 
An analysis of your request under the common law is similarly unavailing.
 
Nevertheless, I provided you with the link to the University webpage that
contains the Stockton COVID-19 Vaccination Report. It is unclear whether
your reviewed the information. I respectfully request that you review the
information available on the University website to determine whether it is
responsive to your needs before proceeding further.
 
If you determine that the information available does not meet your needs,
you are welcome to refine and clarify your request, or submit a new
request.

Quite amazing that a public state institution fails to provide data on
vaccinations to the public via an OPRA request.  I wonder why lawyers hide
behind information vs record when the health/safety of the community is at
stake?  What does Stockton have to hide?  Why not be transparent?  We will
now proceed to make several new OPRA request for emails that are records
and have the data.  Note that we will start with Diane D'Amico's email as
she has already provided some details to the press.   See

Thus clearly there are records of this data and we will continue to seek
it.
 
We dont know how lawyers sleep at night when you deny the public simple
data during a health emergency.
 
We are also filing an immediate appeal with the GRC.
