Use of Force Reports October 2018
Dear Toms River Police Department,
This is a request for public records made under OPRA and the common law right of access. Please acknowledge receipt of this message.
Records requested:
Please provide copies of all of your police department’s Use of Force Reports that were created during October 2018.

Good Day,
These reports are currently being reviewed by our Professional Standard
dept. I should have them sometime late next week. After I receive them
we will need to copy, review, redact appropriately and scan to pdf so they
can be sent. There is a service fee for this. Our service fee is $50.00
per hour plus copies. October has approximately 40 forms and will take
approximately 1 hour to process.
$ 50.00 processing + 2.00 copies. Your total bill will be $52.00. You
can come to PD and pay in cash or check, or you can send a check made out
to “Toms River Township”. Kindly let me know how to proceed. Thank
you.

The township respectfully disagrees. The reports requested are standard reports. The processing fee is for the time taken to copy, review, redact and then scan into a pdf file.

I spoke with our legal department and since this is not a major project, a service charge is not warranted. The copy cost is the only charge. Since there were 40 use of force reports, the fee for copies is $ 2.00 as previously stated. You can mail in the check or money order, or you can stop buy and pay by cash or check. Kindly let me know.
