Tuition File Records for Out-of-District Special Education Placements (2019-2020 to 2025-2026)

We're waiting for Advocate for Transparency to read a recent response and update the status.

Dear Toms River School District,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

I am requesting copies of existing records maintained by the Toms River Regional School District for school years 2019-2020 through 2025-2026 only, limited to the following record series or equivalent records as maintained by the District:

Tuition File - In/Out District, In/Out State, Public/Nonpublic, Vocational-Technical, Post-Secondary, and County Special Services School District (CSSSD), including tuition information, contract agreements, refunds, reports, expenditures, and supporting documentation relating to out-of-district special education placements.

I am requesting the existing records themselves only, as maintained by the District, and I am not requesting that the District create a report, perform research, or compile information from multiple sources.

Student names and other direct personal identifiers may be redacted. Please provide the records electronically in Excel, CSV, or PDF, if possible.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Good afternoon,

The Toms River Regional School District ("District") received your Open
Public Records Act (OPRA) request dated today, May 7, 2026.  The official
Custodian of Records received your OPRA request today, May 7, 2026.  As
such, the seven (7) business day deadline to respond to your request is
Monday, May 18, 2026.  This response to your request is being provided to
you on the day of the custodian's receipt of said request.  

After careful review, the District is unable to fulfill this request as
submitted.  Pursuant to N.J.S.A. 47:1A-5(g), a Records Custodian may deny
a request that would substantially disrupt district operations. 
Specifically, the scope and nature of the request would require an
extensive allocation of time and resources that would significantly
interfere with the district's ability to perform its regular functions.
