SuDru,
For this request, you are seeking " From 3/1/23 to present. Please
send me emails and correspondence mentioning trees, shrubs and
grass AND 162 Valley Run Drive."
In MAG Entm't, LLC v. Div. of Alcohol Beverage Control, 375 N.J.
Super. 534 (App. Div. 2005), the Court held that OPRA "is not
intended as a research tool litigants may use to force government
officials to identify and siphon useful information. Rather, OPRA
simply operates to make identifiable government records 'readily
accessible for inspection, copying or examination.'" Under OPRA,
agencies are required to disclose only "identifiable" government
records not otherwise exempt. In short, OPRA does not countenance
open-ended searches of an agency's files.
Moreover, pursuant to Elcavage v. West Milford Twp. (Passaic), GRC
Complaint No. 2009-07, the Government Records Council set forth a
three-prong test for these types of communications to be the
subjects of a valid request. These requests must contain three (3)
characteristics- 1) Content and/or subject; 2) Specific date or
range of dates; 3) Sender and/or recipient. Your request fails to
specify sender and/or recipient. Therefore, please provide
clarification as to the sender and/or recipient for these
communications.
Best,
Danielle
