Total number of the households using underground septic system and not connected to public sewage
Dear Town of Secaucus,
Pursuant to the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., I am requesting access to records related to the number of households with septic systems in [Municipality Name].
Specifically, I am requesting:
1. The total number of residential properties that rely on septic systems and not connected to public sewage within the municipality. Septic is also known as Individual Sewage Disposal System (ISDS)
I request these records in digital format (CSV, Excel, or PDF) if available. If the information is maintained in a database, I request an export of relevant fields.
If any portion of this request is denied or redacted, please provide a written explanation citing the specific legal reasons for the denial. If the records are available online, I appreciate guidance on how to access them.
Please advise me of any fees before processing the request if they exceed the standard OPRA fee schedule.
Thank you for your assistance. I look forward to your response within the statutory timeframe of seven business days.
Sincerely,

Hello Sir,
Pursuant to N.J.S.A. 47:1A-5(f), requestors should use the agency’s official OPRA request form, but are permitted to submit their request via “a letter, or an email” that includes all information required on the adopted form. Id. This includes answering the certification questions related to “commercial purpose” use and whether the requestor is seeking records in connection with a legal proceeding (including case identifiers if “yes”). This new statutory requirement represents a significant change from the GRC’s prior position after Renna v. Cnty. of Union 407 N.J. Super. 230 (App. Div. 2009) that a written equivalent request would be considered a valid OPRA request if it clearly identified itself as an OPRA request. Custodians may deny access to a written equivalent OPRA request that does not include all form information or that contains substantially more information than required on the form. N.J.S.A. 47:1A-5(f).
Please submit your request via the SDL Portal, or complete the attached request form and email it to [email address] . If you have any questions or concerns, you may contact us.
