Dear New Brunswick City,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

Dear Leslie Zeledon,

This is a request for the disclosable personnel information specified in N.J.S.A. 47:1A-10. If you take the position that this request is invalid because it seeks "information" instead of identifiable "records," before denying this request please review a May 18, 2017 article on http://njopengovt.blogspot.com entitled "Court: OPRA Section 10 allows requestors to ask for personnel 'information,' does not require a request to be for specific, identifiable records."

One of the pieces of information requested is the "payroll record" of a public employee. I invite your attention to pp 3 to 5 of the December 18, 2012 Findings and Recommendations of the Executive Director in Gregory Havlusch, Jr. v. Borough of Allenhurst (Monmouth), Government Records Council Complaint No. 2011-243. The Executive Director wrote that "an employee's payroll records should include information that will allow a person to determine whether an employee took a leave of absence, the dates of the leave, whether it was paid, and if so, the amount of salary received for the paid leave of absence." I'd like all this information regarding the employees that are the subject of this request. So, if the employees were on leave during the period specified, please provide these details.

Records requested:

For Water Dept Clerical staff, I'd like their "name, title, position, salary, payroll record, length of service, date of separation and the reason therefor." For the "payroll record," I'd like it to cover the period beginning 1/1/24 and ending 11/15/24

I am in receipt of your revised request. Kindly be advised, requestors are not required to use an OPRA request form; however, a written equivalent not containing the form requirements of N.J.S.A. 47:1A-5(f) and N.J.S.A. 47:1A-5(g) may be denied by a custodian. Attached for your reference is the most up to date OPRA Form to be filled out by you or you may contain the requirements of the statute noted above in an updated email request.
