This request is for verification of legal fees paid by the township when township is participant in Minicipal JIF.
Dear Maple Shade Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
1. All legal invoices, billing statements, and payment records
related to the Township’s payment of legal fees for the Township Manager in connection with any lawsuit, claim, or legal action filed from January 1, 2020 to present.
This includes:
• Invoices from outside counsel
• Billing detail (time entries, descriptions, rates)
• Payment vouchers
• Purchase orders
• Resolutions authorizing payment
2. All indemnification or defense obligation determinations
made by the Township, Township Solicitor, Joint Insurance Fund (JIF), or any insurer regarding the Township Manager in the above referenced matter(s).
This includes:
• Letters of representation
• Reservation of rights letters
• Coverage determinations
• Defense obligation determinations
• Any correspondence between the Township and the JIF regarding coverage
3. Any findings, determinations, or communications
regarding whether the Township Manager’s actions were:
• within the scope of employment
• outside the scope of employment
• intentional
• malicious
• defamatory or slanderous
• otherwise excluded from indemnification
4. All settlement agreements, releases, or court orders
related to the matter(s), including but not limited to, any documents determining liability, wrongdoing, or slander.
5. All emails, memos, or correspondence
between the Township Council, Township Manager, Township Solicitor, or JIF relating to:
• payment of legal fees
• indemnification
• reimbursement or claw back of fees
• disciplinary action
• personnel decisions related to the litigation
