Dear Riverton Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

I am requesting all submitted documents in regards to the Transportation and Disposal of Wastewater Sludge of prior contracts. Submitted documents include, but are not limited to, Disposal documents or Certified Payrolls. Any Documents that are related to the disposal of wastewater sludge in previous contracts in the past 2 years would be helpful and appreciated.

This OPRA is denied as overly broad. OPRA requests that are a broad cast for "any and all documents" related to a basic subject are routinely denied by the courts and Government Records Council. You must cite the class of records sought.

Further, I would ask you to reconsider this as a commercial request given your OPRA is made for a project we are in the process of collecting sealed bids for and your OPRA specifically references that project. Here's what the State Government Records Council says about Commercial Requests.

Can a requestor seek access to government records under OPRA for commercial use? Yes.

However, under P.L. 2024, c.16, a person seeking to use records for a “commercial purpose” must certify to this fact as part of their OPRA request. For purposes of clarity, “commercial purpose” means:

[T]he direct or indirect use of any part of a government record for sale, resale, solicitation, rent, or lease of a service or any use by which the user expects a profit either through commission, salary, or fee. [N.J.S.A. 47:1A-1.1.]. A requestor who intends to use the record for the above purpose or intends to give the records to another person for such purpose, shall certify that the intended use is for “commercial purpose”.

A requestor intentionally failing to certify that they will not use the record for commercial purposes “shall be subject to a civil penalty of $1,000 for the first offense, $2,500 for the second offense, and $5,000 for each subsequent offense.” N.J.S.A. 47:1A-11. This fine may be imposed by the courts.
