This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
This is a second request for “ All Computer Aided Dispatch, Spillman Direct Messages for Officer Brandon Borriello #16261 and Officer Louis Toscani #16271 from January 1, 2023 til current.”
The requestor is in contact with the Monmouth County Prosecutor’s Office for their input on this matter as Freehold Township’s initial denial, does not support the fact Spillman Direct Messages are governmental records and have the possibility of pertaining information other than confidential information.
Please be advised that your request for “All Computer Aided Dispatch, Spillman Direct Messages for Officer Brandon Borriello #16261 and Officer Louis Toscani #16271 from January 1, 2023 til current” is denied as it fails to properly identify the messages sought. An OPRA request seeking messages, communications, or other correspondence must provide “1) [the] content and/or subject of the [correspondence]; 2) the specific date or range of dates during which the [correspondence] was transmitted ... ; and 3) [the] identity [of] the sender and/or recipient of said [correspondence].” Elcavage v. West Milford Township, GRC Complaint No. 2009-07 (April 2010); see also Serringer v. Office of Governor of State, A-0837-15T2, 2017 WL 2610646 (App. Div. June 16, 2017))(“In order to limit a blanket request, the subject matter of the type of document sought should be identified in the request. ... With these guiding principles in mind, we conclude from our review that plaintiff's request was overly broad.”) The request fails to specify the content and/or subject of the messages sought.
