September 10th email
Dear Pinelands Regional School District,

Records requested:
The original email from September tenth, as sent by Epic and received by Administrator Brennan.

Dear Pinelands Regional School District,
A reminder about this OPRA request, which was due yesterday, November 13th.
This request is simple enough. Please respond to this request today.
Thanks,

This message is to log the dialog I have received directly by email, from the acting PRSD records custodian, regarding this and other requests: it does not need to be responded to.

Subject: OPRA Requests
Mr. Epstein:
As you are aware, on or about November 8, 2017 you received an e-mail from Pinelands Regional School District Board of Education (the “Board”) Interim Superintendent, Dr. Mary Ann Banks which advised you of the following: (1) I am presently the Acting Board Custodian of Records; and (2) that the Board would require until November 17, 2017 to respond to your October 28, 2017 request for records under the Open Public Records Act (“OPRA”) and the Common Law Right of Access.
I am in receipt of your multiple OPRA requests which you e-mailed me on November 8 (1 request); November 10 (1 request); November 12 (2 requests): November 14 (1 request). However, I am not in receipt of the OPRA requests you submitted to Steve Brennan prior to my assignment as Acting Custodian of Records which occurred on November 8; as such, I ask that you kindly resubmit the OPRA requests you submitted to Mr. Brennan prior to November 8 that remain outstanding so as to allow me to review same and respond accordingly.
In addition, due to the volume and nature of your requests, the potential need to request certain documents from third-parties, and the time to review and potentially redact certain records, the Board will require until November 30 to respond to all of your outstanding and pending OPRA requests.
Regards,
Cheryl Stevenson

Subject: Re: OPRA Requests: Clarification and question
Thank you for the update Dr. Stevenson.
There are seven pending requests. These four are admittedly more involved:
10/28: Special and daily reports (as sent by email)
11/12: The “construction concerns” internal system (as sent by email)
11/8: https://opramachine.com/request/asbestos...
11/12: https://opramachine.com/request/dot_corr...
These three are less involved:
11/2 (Followup sent 10/14): https://opramachine.com/request/septembe...
10/10: https://opramachine.com/request/912_emai...
10/14: https://opramachine.com/request/licensed...
I have also rescinded (cancelled) the following two requests:
Finally, as requested, I have resubmitted the 10/28 request. You will find it on OPRA machine:
https://opramachine.com/request/special_...
I hope very much that this is not considered a new request, but rather a repeat of the request that was submitted on October 20th and clarified (at the request of Mr. Brennan) on October 28th.
I understand the delay for the four larger requests, especially considering how you have just stepped into the position. For the three smaller request, as they likely require much less effort, I would hope that those are not included in the delay. Regardless, please replay to each of the above OPRA machine requests as appropriate. They should all be in your email. Simply reply to those emails, and duplicate your response as necessary.
Finally, a question: You said:
“However, I am not in receipt of the OPRA requests you submitted to Steve Brennan prior to my assignment as Acting Custodian of Records which occurred on November 8; as such, I ask that you kindly resubmit the OPRA requests you submitted to Mr. Brennan prior to November 8 that remain outstanding so as to allow me to review same and respond accordingly.”
Can you please clarify: Will any requests received by the district before you were assigned as custodian, whether by me or anybody else, be fulfilled? If those requests are not resubmitted, are you saying that they will not be fulfilled?
Thank you for your time and effort.
Jeff Epstein
