The original request:
This is a request for public records in accordance with the Open Public Records Act and the common law right of access. I certify under penalty of perjury that I have not been convicted of a crime anywhere in the United States.
Teachers and staff were provided an internal-only Google form system, where they were encouraged to document complaints, concerns, and issues regarding roof construction. The system was entitled “Construction FAQ’s”
Please provide all submissions to this system. Specifically, please export all responses to a CSV file.
Also, please "print all responses" to a PDF file. This can be done in Google Chrome, by going to the form and selecting "print all responses." Then, in the Google Chrome print dialog, click the “change” button under "Destination". Then select "Save as PDF."
All of this is demonstrated in the following four screenshots, which have also been mailed directly to you as attachments:

It’s pretty hard to diagnose, not seeing what you’re seeing. But this exact response (the same documents and correspondence) was already sent earlier today to a different request. I don’t see any situation where the same response should be sent to two different requests, so I am unsure what to say at the moment. OPRA Machine Is based on a robust public records system used in multiple places throughout the country. I can only hope that this is a misunderstanding and not a fatal flaw in the system.
Two or three requests have already gone through successfully, so we are clearly getting there.
I would be happy to come in and personally assist in seeing all of these requests through and acclimating you to the system. Just let me know. I am around tomorrow and then will be available again starting on Thursday next week. I am confident this can be done in a way without showing me anything sensitive.
Assisting you through these remaining requests is a top priority.

But, unless I am completely insane (which I do not completely discount as a possibility), it contains the incorrect documents. The request is for “responses to the construction complete system” (scroll up the page and see for yourself) but the responsive documents is the September 12 email.

I already received the September 12 email response in a previous request, a few hours ago. I can only guess that this was just an inadvertent mistake and the system is working just fine. You’ll let me know.

SUMMARY
During a Roofing project on top of a high school, staff members were provided an internal-only Google Form system, where they could lodge complaints and express concerns about the ongoing health issues that occurred during the construction project. There were many. I have confidential screenshots from submissions made into this system. The only input field available to staff members was “a description of the problem.” The staff member’s email address was automatically fed into the system.
I requested all submissions to the system, including all responses to the submissions. It was denied on two grounds:
1. a “grievance filed by or against an individual, shall not be considered a government record.”
2. "a public agency has a responsibility and an obligation to safeguard from public access a citizen's personal information." (This is despite the obvious ability of redacting email addresses and other identifying information.)
IMPORTANT NOTE

THE DENIAL

The District must deny the above-referenced request pursuant to N.J.S.A. 47:1A-10 which provides, “the personnel or pension records of any individual in the possession of a public agency, including but not limited to records relating to any grievance filed by or against an individual, shall not be considered a government record and shall not be made available for public access.”
In addition, the District must also deny this request pursuant to N.J.S.A. 47:1A-1 which provides that “a public agency has a responsibility and an obligation to safeguard from public access a citizen's personal information with which it has been entrusted when disclosure thereof would violate the citizen's reasonable expectation of privacy.” As such, the disclosure of an individual’s complaint or grievance is precluded from disclosure pursuant to the above.

Access to personnel and pension records
C.47:1A-10 Personnel, pension records not considered public document; exceptions.
Notwithstanding the provisions of P.L.1963, c.73 (C.47:1A-1 et seq.) or any other law to the contrary, the personnel or pension records of any individual in the possession of a public agency, including but not limited to records relating to any grievance filed by or against an individual, shall not be considered a government record and shall not be made available for public access, except that:
- an individual's name, title, position, salary, payroll record, length of service, date of separation and the reason therefor, and the amount and type of any pension received shall be a government record;
- personnel or pension records of any individual shall be accessible when required to be disclosed by another law, when disclosure is essential to the performance of official duties of a person duly authorized by this State or the United States, or when authorized by an individual in interest; and
- data contained in information which disclose conformity with specific experiential, educational or medical qualifications required for government employment or for receipt of a public pension, but not including any detailed medical or psychological information, shall be a government record.
