the Open Public Records Act (“OPRA”).  Please accept this as our response
pursuant to OPRA. Attached you will find a letter from David Grubb,
Managing Director of PERMA. In it you will find a portal for a File
Transfer Site. Since this request includes numerous files, we are
providing this information through an FTP site.

 

In addition, please see below for specific responses to your request.

 

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the denial of access. At your option, you may either
institute a proceeding in the Superior Court of New Jersey or file a
complaint with the GRC by completing the Denial of Access Complaint Form.

Dear Municipal Excess Liability Joint Insurance Fund,

 

This is a request for public records made under OPRA and the common law
right of access. I am not required to fill out an official form. Please
acknowledge receipt of this message.

  Records requested:

 

1)            Documents, such as contracts, resolutions, meeting minutes,
or the like, sufficient to show the identity of all persons who held
positions of “fund professionals” (as described at

January 1, 2014 to date of response.  Included on the FTP site are
resolutions 14-1, 15-1, 16-1, 17-1, 18-1, & 19.1 appointing Fund
Professionals.

 

2)            Documents sufficient to show the salary or compensation of
all “fund professionals” as described above, such as contracts, employment
agreements or salary resolutions from January 1, 2014 to date of
response.  Included in the above mentioned resolutions are fees
established by the Board of Fund Commissioners.

 

3)            A list of all contracts or agreements between the fund and
persons functioning as brokers or consultants of the JIFs, and the
invoices, copies of checks, purchase orders, remittances, etc. for each of
these consultants or brokers from January 1, 2014 to date of response. The
JIF does not have contracts or agreements with the Risk Managers, they are
with each individual fund member. However, the JIF pays risk managers.
Included on the FTP site is a worksheet by year  that includes the vendor,
member, date, amount and check number. We do not have cancelled checks on
file. If you require copies of all the vouchers, please advise. We will
need an extention until September 5, 2019 to provide them.

 

4)            Invoices and cancelled checks for all amounts including
compensation fees paid on EPL/POL and cyber security policies from January
1, 2014 to date of response.  Included on the FTP site is a worksheet by
year that includes vendor, description, date, amount & check number made
for EPL/POL &  Cyber (Errors & Omissions) coverage. Also included are
vouchers. We do not have cancelled checks on file.

 

5)            The JIF annual budgets, showing receipts and expenditures,
for each of the fund’s last five fiscal years.  Included on the site are
budgets for the past five years along with a worksheet with assessment
payments received from JIF members (receipts). On the Camden JIF website
at  camdenmunicpaljif.org/meetings-agenda, are agendas that includes bills
list, listing all expenditures made by the Fund.

 

6)            A copy of any financial or performance audits of the JIF for
the last five fiscal years. Included are audits from 2014 to 2018; they
also appear on the JIF website at
camdenmunicpaljif.org/finance/independent-audits.

 

7)            Any annual report(s) of evaluation, summary of activities
and operations between January 1, 2014 and date of receipt. Included are
marketing materials for the JIF.  

 

8)            All job advertisements or announcements for JIF positions
that set establish the powers and duties of JIF fund professionals,
contractors or brokers and any enumeration of responsibilities of these
jobs for the past five years. Included are advertisements for fund
professionals and all Request for Qualifications released by the Fund for
the past five years.
