Dear Seaside Heights Borough,

Please accept this electronic request for public records made under the New Jersey Open Public Records Act (OPRA) and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request, as per N.J.S.A. 47:1A-5(f), which states that a written request that includes all the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Pursuant to OPRA and the common law right of access, I hereby request copies of the following government records in the possession, custody, or control of the Seaside Heights Police Department:
1. All written policies, memoranda, standard operating procedures (SOPs), directives, orders, or any other governing documents relating to the drug testing policies and procedures applicable to officers of the Seaside Heights Police Department, excluding the New Jersey Attorney General’s Law Enforcement Drug Testing Policy, which is already known and therefore not within the scope of this request.
2. Any and all written policies, memoranda, SOPs, directives, orders, or other governing documents specific to the drug testing of Special Law Enforcement Officers (SLEOs), particularly Special Law Enforcement Officer Class I (SLEO I) personnel.
3. Any internal department policies, instructions, or correspondence detailing the procedures for initiating, conducting, and handling drug testing results for officers within the department, including any specific procedural deviations applicable to SLEO I personnel.

If these records exist in electronic format, I request that they be provided via the OPRAMachine platform. However, if a technical failure with the platform prevents timely compliance, I request that the records instead be sent to [email address] as an alternative delivery method.

Should any portion of this request be denied or withheld under a claim of exemption, please provide the legal basis for such denial and identify the specific records being withheld, as required under OPRA.
