Request to Approve Plea Agreement Forms

The request was refused by Scotch Plains Township.

Please accept this as my request for government records under both OPRA and the common law right of access. Thank you very much for your commitment to transparent government.

BACKGROUND:

An Appendix to Part VII of the New Jersey Court Rules, titled "Guidelines For Operation Of Plea Agreements In The Municipal Courts Of New Jersey" allows the Scotch Plains Municipal Prosecutor to submit "a Request to Approve Plea Agreement . . . signed by the prosecutor and by the defendant" instead of appearing in person on the record whenever a plea agreement is entered into.

RECORDS REQUESTED:

1. Each "Request to Approve Plea Agreement" form, whether in hard copy or electronic, submitted during January, February and March 2023 for plea agreements that resolved non-traffic offenses.

2. For each person who presently serves as Scotch Plains Municipal Prosecutor, his or her "name, title, position, most recent annual salary and length of service." (See N.J.S.A. 47:1A-10).
