Dear East Brunswick Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Active Code Violation List Request for 05/27/2025 to 08/27/2025. I kindly request a list of all UNRESOLVED or OPEN code violations (please do not include closed violations) for all properties in the city during this time period, specifically related to property maintenance, structural issues, and weeds, tall grass, water shutoffs, Mold/Mildew. Please include descriptions of the violations, property addresses, and violation dates, homeowner's name. I also prefer for the document to be sent here in OPRA, not in my email (sometimes it does not appear in my inbox).
Please provide these requests in excel or google sheets format, documents must be in format requested per OPRA
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Thank you for your reply. However, I must respectfully insist that my OPRA request submitted via email is valid and must be processed by your office.
Per N.J.S.A. 47:1A-5(g), “A request shall be in writing and hand-delivered, mailed, transmitted electronically, or otherwise conveyed to the appropriate custodian of the record requested.” Further, N.J.S.A. 47:1A-5(f) makes clear that a public agency cannot require that a request be submitted on a specific form, and an email containing all required information is a valid government records request.
As the custodian of records for East Brunswick Township, your office is legally obligated to provide access to the records I requested or issue a lawful denial citing the specific exemption under OPRA. Redirecting me to a third-party portal is not a substitute for compliance with the statute.
Therefore, I am requesting again that my OPRA request for the Active Code Violation List (05/27/2025 – 08/27/2025) be processed directly by your office and the records be provided in Excel or Google Sheets format via email attachment, as I originally specified.
Please confirm that this request is being processed by your office as required under OPRA.

As custodian of records, your office is obligated either to provide access to the requested records in the medium requested or to issue a lawful written denial citing the specific exemption under OPRA. Redirecting me to a third-party portal does not satisfy this statutory requirement.
Accordingly, I again request the Active Code Violation List (05/27/2025 – 08/27/2025) to be provided in Excel or Google Sheets format, as originally specified. Additionally, I prefer for the document to be sent directly here in OPRA rather than to my email inbox, as messages sometimes do not appear there.
Please confirm that this request is being processed by your office in compliance with OPRA.
