OPRA Request - City of Atlantic City
Re: Justin Williams (Incident Date: December 31, 2023)
Good afternoon,
Please be advised that your request for medical transport records has been
denied due to privacy concerns pursuant to N.J.S.A. 47:1A-1 (privacy
interest).
“A public agency has a responsibility and an obligation to safeguard from
public access a citizen's personal information with which it has been
entrusted when disclosure thereof would violate the citizen's reasonable
expectation of privacy. “ See Burnett v. County of Bergen, 198 N.J. 408
(2009).
Also, your request for the booking photo (mugshot) has been denied. The
GRC has ruled that OPRA exempts photos of people arrested from disclosure.
Melton v. City of Camden, 2011-233 (2013).
An additional extension of time until May 28, 2026, is needed for the
Atlantic City Police Department to provide a response.
Thank you.
