Request for Body-worn Camera Footage (FOIA)

We're waiting for Justin Turner to read recent responses and update the status.

Dear Atlantic City,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:
Suspect Name: Justin Williams

Location: 1st block of North Georgia Avenue, Atlantic City, NJ.

Charges: Kidnapping, Aggravated Assault, Robbery, Possession of a Weapon for an Unlawful Purpose, and Terroristic Threats.

Agency: Atlantic City Police Department (ACPD).

Incident Date: December 31, 2023.

Incident Details: Police responded to a residence on New Year's Eve where Williams was allegedly holding two women he knew hostage. One victim escaped upon police arrival; the second was released after Williams surrendered following negotiations. Williams reportedly threatened the victims with a large knife and attempted to throw one victim out of a window.

Specific Items Requested
Body-Worn Camera (BWC) & Dash Camera: All available footage from responding ACPD officers on December 31, 2023. This includes the initial scene arrival, the escape of the first victim, the negotiation process leading to the suspect’s surrender, and the recovery of the second victim and the weapon.

911 & Dispatch Audio: The emergency call reporting the assault/hostage situation and all police radio transmissions detailing the tactical perimeter and the suspect's surrender.

Investigation Reports: The full ACPD Incident Report, the investigative narrative from the Criminal Investigations Unit, and supplemental reports regarding the stolen property and the weapon (knife) recovered at the scene.

Medical Transport Records: Documentation regarding the transport of one victim to AtlantiCare Regional Medical Center for treatment of assault-related injuries.

Booking & Custody Records: The booking photo (mugshot) and intake records for Justin Williams at the Atlantic County Justice Facility.

interest).

“A public agency has a responsibility and an obligation to safeguard from
public access a citizen's personal information with which it has been
entrusted when disclosure thereof would violate the citizen's reasonable
expectation of privacy. “ See Burnett v. County of Bergen, 198 N.J. 408
(2009).

 

Also, your request for the booking photo (mugshot) has been denied. The
GRC has ruled that OPRA exempts photos of people arrested from disclosure.
Melton v. City of Camden, 2011-233 (2013).

Good morning,

 

Please be advised that the attached OPRA request must be denied as the
request is exempt under the Prevention of Domestic Violence Act of 1991.
All records maintained pursuant to this act shall be confidential and
shall not be made available to any individual or institution except as
otherwise provided by law. N.J.S.A. 2C:25-33. Additionally, there are no
exceptions in the statute that provide for exceptions to access for
victims. N.J.S.A. 41:1A-6; N.J.S.A. 47:1A-9(a); N.J.S.A. 2C:25-33; VanBree
v. Bridgewater Twp. Police Dep’t (Somerset), GRC Complaint No. 2014-122
(October 2014). Therefore, the request must be denied.
