Dear Elizabeth City,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

This email is regarding the Open Records Request request received on
02/20/2026.

 

The request seeks access to the following records:

OPRA #749 (Case #26-029157)

 

The request has been Denied as listed below:

Law Dept As this matter is still pre-indictment, an investigation
remains in progress at least until the criminal matter
has been presented to the Grand Jury as releasing the BWR
may jeopardize the investigation conducted by the
prosecutor’s office leading up to an indictment
proceeding. Accordingly, BWR and requested police records
for this matter cannot be provided at this time.
In addition, OPRA`s `investigations in progress`
exemption also applies here because (1) the requested
records pertain to an investigation in progress by any
public agency, (2) disclosure will be inimical to public
interest, and (3) the records were not available to the
public before the investigation began. N.J.S.A.
47:1A-3(a); Paff v. Ocean Cty. Prosecutor`s Office, 235
N.J. 1, 24 (2018).

 

If you feel that you were unlawfully denied access, you have the right,
within 45 days from the date of denial, to either file a complaint with
the New Jersey Government Records Council or file an action in Superior
Court which shall be heard in the vicinage where it is filed by a Superior
Court Judge who has been designated to hear such cases.
