Please see below for clarifications on the items:

1. I am sp seeking a motor vehicle accident report in which under Sheriff Ray Vasquez was involved with a county vehicle. I do not have a particular date however this accident was investigated by Lieutenant Matthew Fedrow of the Hudsen County sheriffs office and then referred to the Hudson County prosecutor’s office. I have submitted a request to the Hudson County sheriffs office and they stated in writing I must do my request with the prosecutors office. Additionally, I am seeking any incident reports or written, explanations that was written by under Ray Vasquez in regards to this motor vehicle accident with the county vehicle.

2. From my understanding “motor pool“ also keeps records of this incident in which I have explained to the Oprah personnel at the Hudsen County sheriffs office and they again stated I have to request it through the prosecutor’s office.

3. From what I am being told this incident in regards to another car accident with a County vehicle by County executive Craig guy has also been investigated by the “motor pool” of the Hudson County sheriffs office. I have made my request as well for this item and they referred me to the Hudson County prosecutor’s office.

Again the HCPO requests that you respond by clearly requesting specific identifiable records. It is unclear what records you are seeking besides a motor vehicle accident/collision report (Item 1a). "Any incident report”, "motor pool records", and "written explanations" remains broad and vague. Please clarify.

Please be aware that the HCPO does not prepare NJ NJTR-1 Collision Reports. As such any NJTR-1 in the HCPO possession would be "courtesy copies" under OPRA. Therefore, you should consider making this request to the Hudson County Sheriff's Office. Please be aware that the Custodian of those records may assert any exception, exemption or privilege under the law.

Similarly, your request for Hudson County Sheriff's Office motor pool "records" regarding two collisions: (1) involving Undersheriff Vasquez, and (2)
involving County Executive Guy, should again be made to the Hudson County Sheriff's Office as the HCPO does not prepare or possess the above referenced records.

Please also be aware that each county prosecutor, as the Chief Law Enforcement Officer of their respective county, is vested with the power within their county to use all reasonable and lawful diligence for the detection, arrest, indictment and conviction of offenders against the laws. N.J.S.A. 2A:158-5. However, the Prosecutor, does not have direction, control, nor oversight of law enforcement agencies operating within Hudson County regarding OPRA or CL requests. Any issue regarding an agency's response should be addressed according with that agency.

Maureen O'Doherty, specifically stated that she does not have those specific records and those records we have to be requested at your office.
