OPRA allows public agencies to impose special service charges when fulfilling a request requires an extraordinary expenditure of time and effort. See N.J.S.A. 47:1A-5.c. Special service charges must be based upon the actual direct cost of providing the copy or copies.
Ocean County College has the reason for each tuition appeal located in a letter that is sent to each student who has filed an appeal. The letters are physically located in a file. It is estimated that there are approximately 125 letters per year (125 x 4 = 500) and that the years requested would take 10 hours. The letter includes the student's information, therefore, the copies would also need to be redacted which would involve another estimated 5 hours of time.
$11.00 per hour x 15 = $165.00
