Responsive records are attached.
Be advised that building plans are exempt from disclosure under OPRA due
to the potential release of “emergency or security information or
procedures for any buildings or facility which, if disclosed, would
jeopardize security of the building or facility or persons therein.” See
N.J.S.A. 47:1A-1.1; N.J.A.C. 5:3-2.2. Pursuant to the common law, your
request for building plans is also denied. Under the common law, a
request for government records is subject to a balancing test to weigh a
municipality’s interest in nondisclosure against a requestor’s interest in
obtaining the records. See, e.g., Gilleran v. Township of Bloomfield, 227
N.J. 159, 177 (2016) (noting that to conduct a common law analysis for
government records, the requestor must convey the reason that he/she seeks
access to the records). The Township cannot conduct the required balancing
test without the requestor's identity and reason for needing the records.
