"notification" of the asbestos removal plan was required to be sent to the NJ Department of Environmental Protection at least ten days in advance of any removal or disposal of asbestos. After requesting this document from NJDEP, they recommended instead contacting the Department of Health.

Please provide all asbestos removal/transport plans, as submitted during the year of 2017. Also provide any correspondence, documents, or responses related to this plan. This includes acknowledgement of, responses to, or correspondence between the department and the district, or with one of its contractors, Kobithen Roofing and Insulation, or New Road Construction.

The Division of Epidemiology, Environmental and Occupational Health received your Open Public Records Act (OPRA) request below. As explained to you over the telephone today, we searched our records and found none responsive to your request. The 10 day notification form referenced in your request, is waived for the Department of Health in cases involving roofing. Sometimes the entity will send the Department the form anyway, but we checked and found nothing. It is our opinion that the form should be on file in the Department of Environmental Protection.

If your request for access to a government record has been denied or unfilled within the seven (7) business days required by law, you have a right to challenge the decision by the Division of Epidemiology, Environmental and Occupational Health to deny access. At your option, you may either institute a proceeding in the Superior Court of New Jersey or file a complaint with the Government Records Council (GRC) by completing the Denial of Access Complaint Form.
