Dear Alpine Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Dear Mr. Michael,

OPRA allows public agencies to impose special service charges whenever the
nature, format, manner of collation, or volume of a government record
embodied in the form of digital/printed matter to be inspected, examined,
or copied pursuant to this section is such that the record cannot be
reproduced by ordinary document copying equipment in ordinary business
size or when fulfilling a request requires an extraordinary expenditure of
time and effort. See N.J.S.A. 47:1A-5.c; see also, Thorpe v. Kleinman 2024
WL 4647806.  Special service charges must be based upon the actual direct
cost of providing the copy or copies.

OPRA mandates that the requestor shall have the opportunity to review and
object to the charge prior to it being incurred.  See N.J.S.A. 47:1A-5.c. 
As such, a detailed estimate is provided below:

I am estimating there will be approximately 2.5 hours of work required to
review and redact two videos.  We require a retainer fee up front that is
double the estimated cost prior to beginning any work.

If you would like to proceed, I require a check be made out to “Borough of
Alpine” in the amount of $433.20 (double the estimated cost) mailed or
dropped off at the address below.   You will be provided a detailed
invoice for the hours expended and you will be refunded any unused funds.
You may also be asked to provide more money prior to releasing if the man
hours are more than expected due to unforeseen circumstances.  Please be
further advised that should you seek more limited records we will adjust
the estimated costs accordingly which may avoid a special service charge
if the time to review and redact does not require an extraordinary
expenditure of time and effort to accommodate the request. However, any
subsequent change in the scope of records will restart the time frame in
which the Borough is obligated to respond.
