The request by you is not a valid OPRA request for the following reason:

The OPRA (Open Public Records Act) law is intended to provide access to
government records that have been specifically identified and requested.
It does not require that the Custodian of Records become a researcher for
the person making the request.  The requestor needs to identify the record
that is being requested and the Custodian of Records needs to provide
access to that specific record, unless it is exempted under the provisions
of the law. Your request is requesting that this office conduct research
to determine if such records exist.  This does not identify a specific
record, but rather asks for this office to perform a search to determine
if any of the above exists and subsequently provide the record.  This is
not identifying a record.  Therefore, your request is invalid.  As
mentioned above the law does not require that the Custodian of Records
become a researcher for the person making the request.  The requestor
needs to identify the record that is being requested and the Custodian of
Records needs to provide access to that specific record, unless it is
exempted under the provisions of the law.

Copies of any/all of any document are not considered a valid OPRA
request.  As such, your request is an invalid OPRA request and is denied.
When a request is “complex” because it fails to specifically identify the
documents sought, then that request is not “encompassed” by OPRA. See New
Jersey Builders Association v. New Jersey Council on Affordable Housing,
390 N.J.Super. 166, 180 (App. Div. 2007).  A proper request under OPRA
must identify with reasonable clarity those documents that are desired,
and a party cannot satisfy this requirement by simply requesting all of an
agency's documents.  See Bent v. Stafford Police Department, 381
N.J.Super. 30, 37 (App. Div.  2005). Custodians are not required to
conduct research or create new records in response to an OPRA request.

The Borough of Garwood shares Board of Health services with the Town of
Westfield, 425 East Broad Street, Westfield, NJ 07090.  Please contact the
Municipal Clerk to request records or make an appointment to view
records.  Tara Rowley, Town Clerk  [5][email address]

PLEASE DO NOT USE OPRA TO SEEK INFORMATION.  PLEASE VISIT THE GOVERNMENT
RECORDS COUNCIL WEBSITE TO LEARN HOW TO PROPERLY REQUEST A DOCUMENT.

[6]https://www.state.nj.us/grc/

This request has been denied pursuant to N.J.S.A.

47:1A-5.f & Government Records Council Advisory Opinion 2006-01 on the
basis that the request is not for specific government records but is
seeking "information". Government agencies are required to disclose only
identifiable government records that are specifically described in the
request. Gannett N.J. Partners v. Middlesex, 379 N.J. Super. 205, 212
(App. Div. 2005), Bent v Twp of Stafford Police Dept, NJ Super. 30, 33
(App Div 2005).

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Borough of Garwood to deny access.
You have a right to appeal the decision. You may take your appeal to the
Government Records Council, P.O. Box 819, Trenton, NJ 08625, or to the New
Jersey Superior Court, as provided by N.J.S.A. 47:1A-1 et seq.  At your
option, you may either institute a proceeding in the Superior Court of New
Jersey or file a complaint with the Government Records Council (GRC) by
completing the Denial of Access Complaint Form.  You may contact the GRC
by toll-free telephone at 866-850-0511, by mail at P.O. Box 819, Trenton,
NJ, 08625, by e-mail at [7][email address], or at their web site at
[8]www.state.nj.us/grc. The GRC can also answer other questions about the
law.  All questions regarding complaints filed in Superior Court should be
directed to the Court Clerk in your County.
