Dear Red Bank Borough,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

1. Legal invoices from October 1, 2020 through December 31, 2021 from any attorney paid by the Borough with entries for legal work performed in connection with negotiating a successor labor agreement between the Borough and PBA Local 39.

2. Invoices or receipts for payments made to police officers with the assignment of detective for any non-salary item from October 14, 2016 through present.

3. A copy of any collective negotiations agreements, side bar agreements or other memoranda of agreement (excluding disciplinary documents) dated between October 1, 2020 through present.

4. Resolutions regarding accrued sick leave or other retirement payouts to any police officer from October 1, 2016 through present.

received via email on 2/1/2022.  This response is being provided on the
seventh business day after the receipt of your request. 

Attached please find document(s) in response to your recent OPRA request. 
 Most of the requested documents do not exist.  Please see notation below:

Dear Pam Borghi,

Thank you for the attachment. Please note that you provided a memorandum of agreement for a successor agreement with the PBA, but did not provide any invoices for fees paid to labor counsel. The term "successor collective negotiations agreement" was expressly used in the MOA. It seems you made a mistake because it is unlikely, if not impossible, that Red Bank did not use (and therefore pay for) any legal services to assist it in negotiations with the PBA, especially considering there is an annual appointment for labor counsel to exceed $17,500 per year.

To fulfill my original request please provide legal invoices from the Borough's labor counsel during the specified period that reflect negotiations-related fees. If you still contend that no such records exist, please confirm that you or labor counsel has reviewed the invoices along with the initial request and still determined that labor counsel never charged Red Bank to negotiate and draft agreements related to a successor agreement, which seems impossible given the MOA.
