Pass the Trash Law Compliance and David Wolfelsperger Hiring Records
To the Custodian of Records:
I am submitting this follow-up request pursuant to the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., regarding my prior request for records related to Wallkill Valley Regional High School’s compliance with P.L. 2018, c. 5 (“Pass the Trash Law”).
In response to my original request, the district provided only nine Sexual Misconduct/Child Abuse Disclosure forms covering the period from January 1, 2022 through March 1, 2026. Based on publicly available Board of Education hiring approvals and district staffing records, it appears that substantially more than nine individuals were hired by the district during that time frame.
Wallkill Valley Regional High School Board of Education minutes and agendas are missing from the district website for a portion of time from June 2023 until April 2025. Even with that considerable amount of information missing, the district hired the followed individuals to permanent positions within the district during the time in which only NINE Sexual Misconduct/Child Abuse Disclosure forms were provided. This list EXCLUDES coaches/extracurricular positions.

Accordingly, I am requesting the following additional records:
1. Documentation identifying the total number of employees hired by the district between January 1, 2022 and March 1, 2026 who were subject to the pre-employment disclosure requirements under P.L. 2018, c. 5.
2. An explanation, in record form, of why only nine disclosure forms were produced in response to my original OPRA request, including any records showing whether certain hires were exempt from compliance and the legal or procedural basis for such exemption.
3. Copies of all additional Sexual Misconduct/Child Abuse Disclosure Release forms, State of New Jersey forms, district-created forms, employer verification responses, or equivalent documentation for any employees hired during that period that were not included in the original response.
4. All records demonstrating compliance with P.L. 2018, c. 5 for the hiring of David Wolfelsperger prior to his approval by the Board of Education, including but not limited to:
* completed disclosure forms signed by Mr. Wolfelsperger;
* prior employer verification requests and responses;
* records reflecting how the district was informed of active investigation(s) in the Mountain Lakes School District, allegations, disciplinary matters, tenure charges, and/or findings involving sexual misconduct, inappropriate conduct with students, or child abuse;
* any internal correspondence, memoranda, notes, or administrative records concerning review of this information prior to his hiring recommendation and Board approval.
5. The date on which the district determined Mr. Wolfelsperger had satisfied the statutory requirements of P.L. 2018, c. 5 and was eligible for employment consideration.
If any portion of these records contains personally identifiable information or other exempt material, I request that such information be redacted and the remaining records be produced.
If access to any portion of this request is denied, please provide the specific legal basis for the denial, including the statutory exemption relied upon.
