Good Afternoon,

 

The Township of Wall Police Department’s (“Police Department”) Records
Custodian received your Open Public Records Act (“OPRA”) request dated May
28, 2020 on May 28, 2020.  As such, the seven (7) business day deadline to
respond to your request is June 8, 2020.  The Police Department is
responding to your request within seven (7) business days after receipt of
your request as required by New Jersey law N.J.S.A. 47:1A-5.

 

For ease of reference, the Police Department notes that your OPRA request
seeks the following:

 

1.      All use of force reports completed by the police department from
January 1st 2017 to December 31st, 2019.

 

Your request requires additional time beyond the seven (7) business days
to fulfill due to a lack of available staff, the location, volume, and
nature of the documents sought. The records also require our thorough
review and redaction to ensure that any confidential, privileged, or
otherwise exempt information is not inadvertently disclosed.  N.J.S.A.
47:1A-1 provides that “a public agency has a responsibility and an
obligation to safeguard from public access a citizen’s personal
information with which it has been entrusted when disclosure thereof would
violate the citizen’s reasonable expectation of privacy.”  N.J.S.A.
47:1A-9.b allows exemptions from disclosure any grant of confidentiality
established or recognized by the Constitution of this State, statute,
court rule or judicial case law, to apply to OPRA.

 

An extension of five (5) business days will be required through the end of
business on June 15, 2020.  The Police Department would also reserve the
right to request an additional extension of time, if necessary, in
accordance with New Jersey law.  See Scheeler v. New Jersey Department of
Educ., GRC Complaint No. 2014-123 (Feb. 2016).
