I am in receipt of your OPRA request. The seven business day deadline to respond to your request is today June 8, 2020. Your request requires additional time beyond the seven business days to fulfill. OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5i. Specifically, OPRA states that, "the requestor shall be advised by the custodian when the record can be made available. If the record is not made available by that time, access shall be deemed denied."

Your request requires an extension of time until June 26, 2020. If your request for access to a government record has been denied or unfilled within the seven business days required by law, you have a right to challenge the decision by the Borough of Mount Arlington to deny access. At your option, you may either institute a proceeding by the Superior Court of New Jersey or file a complaint with the Government Records Council by completing the Denial of Access Complaint Form. The Borough of Mount Arlington received your Open Public Records Act (OPRA) request on June 8, 2020. Additional time was required to respond to your request. This response is being provided to you on July 7, 2020.

Your request seeks the following information:

1. “…all employees who worked in the police department at any point of time from 2012-2019: Please provide the name, hire date, current status (whether active or separated), and date of separation…”
No records exist responsive to this request. As no records exist, your request for these records is denied. See, Bailey v. Department of Agriculture, GRC Complaint No.: 2003-116, Tyrone Jamison v. City of New Brunswick, GRC Complaint No.: 2013-252.

If your request for access to a government record has been denied or unfilled within the seven (7) business days required by law, you have a right to challenge the decision by the Borough of Mount Arlington to deny access.
