Dear Records Custodian:

Please accept this electronic request for government records pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq., and the common law right of access.

This request is valid by email and need not be submitted on any particular form or platform.

I have not been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I will not use the requested records for a commercial purpose.

I am not seeking these records in connection with a legal proceeding.

I request electronic copies of the following records:

1. The complete request from the Middle States evaluation team for additional documentation and follow-up items referenced in the March 2026 Board materials, including all attachments, enclosures, and transmittal emails or letters.

2. All records submitted or prepared by Sussex County Community College in response to that request, including response packets, supporting materials, exhibits, attachments, and cover emails or letters.

3. All emails, letters, memoranda, or other written communications between Sussex County Community College and the Middle States Commission on Higher Education, or members of the evaluation team, from March 1, 2026 through April 15, 2026, concerning:
(a) the request for additional documentation;
(b) follow-up items;
(c) the accreditation visit;
(d) trustee preparation;
(e) governance and operations;
(f) the Board’s policy review process;
(g) how the Board supports the President; and
(h) Standard VII.

4. All agendas, briefing materials, talking points, preparation memoranda, handouts, sample questions, question-and-answer guides, notes, or similar materials prepared for trustees or employees in connection with the March 2026 Middle States visit.

5. All records concerning the trustees’ breakfast or session with the Middle States team, including scheduling records, calendar invitations, agendas, attendee lists, and briefing materials.

6. Any post-visit summary, memorandum, debrief, notes, or follow-up communication created between March 31, 2026 and April 15, 2026 concerning the visit or any further requests made by Middle States or the evaluation team.

Please provide the requested records by email attachment and confirm receipt of this request.

If any portion of this request is denied, please identify each withheld or redacted record and state the specific legal basis for the denial. If you are not the proper custodian, please forward this request to the appropriate custodian and provide that person’s name and email address.

Items 3-6: Be advised, these are invalid requests as they are overly broad and fail to identify specific government records with any clarity. OPRA requires that a request identify specific records in a manner that allows the custodian to locate and produce them without conducting open-ended searches and research. Requests phrased as “any and all records”, “all documents related to”, or similar broad terms are routinely deemed invalid. See MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005); Bent v. Stafford Police Dep’t, 381 N.J. Super. 30 (App. Div. 2005); New Jersey Builders Ass’n v. New Jersey Council on Affordable Housing, 390 N.J. Super. 166 (App. Div. 2007). Additionally, requests for emails must provide the (a) content and/or subject matter; (b) specific date or date range; and (c) sender and/or recipient. Elcavage v. West Milford Twp. (Passaic), GRC Complaint No. 2009-07 (April 2010).

I write again to request a working link to the OPRA-responsive Middle States materials previously produced by Sussex County Community College.

As you will recall, SCCC previously granted Items 1 and 2 of this request and stated that the responsive files were too large to email, providing a Dropbox link for the remaining materials. After the request was marked complete, that link was deleted or disabled. I therefore requested that SCCC restore the link or provide a new one.

The prior production reportedly consisted of more than 3,000 pages of materials. Respectfully, re-providing access to records already gathered, reviewed, and produced should not require a new multi-week review period or take months to complete. If the original Dropbox link was removed, please either reactivate it or provide a new download link.

This is particularly important because the prior production is now directly relevant to whether SCCC’s Middle States submissions omitted the August 22–23, 2023 bomb-threat incident, despite the public record reflecting a serious campus-safety matter involving threats, law-enforcement response, and institutional notices. The public link may have disappeared, but the public-record issue has not.

Please provide a working download link, or confirm the date by which one will be provided. Nothing in this correspondence should be construed as narrowing, withdrawing, or modifying the pending OPRA and common-law request.
