OPRA Request For Bodycam Footage & Incident Reports
Hello,
Under penalty of NJSA 2C-28-3.1 I certify that I, Keith Moreno of Houston, Texas, have not been convicted of any indictable offense under the laws of New Jersey, any other state or the United States.
Under the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq., I am requesting an opportunity to obtain all body-cam footage, dash-cam footage from police vehicles, and any incident reports pertaining to Incident #25-000030 on 1/1/2025 involving officer Corey Lloyd UOF25-1-2 and a 31-year-old Hispanic male suspect
If multiple officers with active BWC responded to this incident, I would appreciate footage POVs of a primary and secondary arresting officer. I apologize for not being able to provide you with the arrestee's name, or time and location of incident, I hope the information provided will nonetheless be enough to retrieve these records.
These records are not being sought for commercial purposes, or legal purposes. I'm extremely grateful for all of your assistance in this matter. Ongoing Investigation: Please be advised
Regarding body-worn recordings and incident there are no
report requested, please be advised that they responsive
currently cannot be provided because the records for dash
incident is currently under investigation by camera footage.
the Union County Prosecutor’s Office (UCPO).
Pursuant to N.J.S.A. 47:1A-3(a), records
pertaining to an investigation in progress
“may be denied if the inspection, copying or
examination of such record or records shall
be inimical to the public interest.” Release
of any pertinent records could jeopardize the
investigation and prevent the UCPO from
making full and conclusive findings which,
given the severity of the matter, would be
inimical to public interest. Furthermore,
during the pendency of the investigation, the
UCPO is the custodian of records pertaining
to this matter, and can only release records
under the authorization of the UCPO.
Notwithstanding the above, with the exception
of body-worn recordings (BWR), these records
are also exempt from disclosure under OPRA’s
criminal investigative material exemption.
Pursuant to N.J.S.A. 47:1A-1.1, a criminal
investigatory record is exempt from
disclosure under OPRA when it meets the
statutory two-prong test: that the record
“‘not be required by law to be made,’ and the
record must ‘pertain […] to any criminal
investigation or related civil enforcement
proceeding. See O`Shea v. Twp. of West
Milford, 410 N.J. Super. 371 (App. Div.
2009).
You have a right to challenge the decision to deny access. At your option,
you may either institute a proceeding in the Superior Court.
