In further response to your OPRA request, our I.T. department has
thoroughly explored the possibility of generating the email log report you
requested. We are familiar with the Paff v. Galloway Township case you
cited. In that case, the Township conceded that production of the
requested report did not impose a significant technological burden, as the
log could be generated by expending two or three minutes of its IT
specialist’s time.

In our case, however, after extensive investigation and consultation with
our outside vendor, we are informed that our system is not capable of
exporting and generating the email log you have requested. Accordingly, as
we are not required by OPRA to create a new government record in response
to your request, and we do not have the technical capability to generate
this information, we are denying your request.

We also note that in the Paff case, the request was for an email log for
two individuals over a two-week period. You have requested logs for 6
individuals over an entire academic year, which will be an enormous number
of emails. The only way we will be able to satisfy your request is to
export all of the emails requested and redact the bodies of the emails.
Additional redaction will no doubt also be required to protect
confidential student, personnel or other protected information in the
email headers. Since this would constitute a search for emails, if you
wish to pursue this course you will also need to provide us with the
subject matter of the email headers you are seeking. Please advise if you
wish to pursue this avenue and provide the required subject matter
information, and we will estimate the amount of time that will be required
to produce the information and whether a special service charge will be
warranted.
