OPRA: police officer-involved lawsuits 2012-2019

We're waiting for Taeho Kim to read recent responses and update the status.

Dear Holmdel Township,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Records requested:

1. A list of all lawsuits and cases in which any officer of the police department was involved between 2012 and 2019. For each lawsuit/case, please provide the date (month and year) of the alleged incident at issue, whether the alleged incident was excessive force, settlement amount (if any), and final compensation amount ruled (if any).

2. Please provide copies of the complaint in any lawsuits and cases described above.

This office is in receipt of your OPRA request dated May 27, 2020.
Attached please find documents responsive to paragraph 2 of your OPRA
request. Your request contained in paragraph 1 is denied insofar as it
requests the Township to compile a “list” containing various data. OPRA
only permits a requester to seek “identifiable government records.” MAG
Entertainment, LLC v. Division of ABC, 375 N.J. Super. 534, 546 (App. Div.
2005). OPRA “only allows requests for records, not requests for
information.” Bent v. Twp. of Stafford Police Dep’t, 381 N.J. Super 30, 37
(App. Div. 2005). “Wholesale requests for general information to be
analyzed, collated and compiled . . . are outside OPRA’s scope.” Burke v.
Brandes, 429 N.J. Super 169, 174 (App. Div. 2012) (emphasis added).

 

Please be advised that this is a full and complete response to your OPRA
