Dear UC Research:
The Borough of Mantoloking received your Open Public Records Act (OPRA)
request May 28, 2020. Please accept this correspondence in response to
your request. Your request sought the following:
1. A list of all lawsuits and cases in which any officer of the police
department was involved between 2012 and 2019. For each lawsuit/case,
please provide the date (month and year) of the alleged incident at issue,
whether the alleged incident was excessive force, settlement amount (if
any), and final compensation amount ruled (if any).
2. Please provide copies of the complaint in any lawsuits and cases
described in above.
For Item #1, please be advised there are no documents responsive to your
request pursuant to NJSA 47:1A-1.1. The Borough does not make, maintain
or keep on file a list of all lawsuits and cases in which any officer of
the police department was involved between 2012 and 2019 with the
requested information, nor is the Borough required to create a document in
order to respond to a request. As there is no document responsive to item
1 of your request, item 2 cannot be satisfied, because it is broad or
unclear and fails to specify a particular document.
Regards,
Lynne Hazelet
